Abstract:

Předkládaná disertační práce na téma „Vývoj trestního soudnictví v Německu 1933 – 1945“ zodpovídá následující okruh problémů: Jak bylo možné, že se německá justice a němečtí právníci dali do služeb nacistickému zločinnému režimu a pomohli mu prosazovat jeho zločinnou politiku a jaké faktory k tomu přispěly? Jakou roli přitom hrál zákonodárce, právní věda, nacistická ideologie, stav justice ve Výmarské republice a další faktory, jako byla válka, řízení justice a osobnost soudce? Jak se němečtí soudci sami podíleli na spáchaných zločinech a nakolik sami svou činností přispěli k likvidaci odpůrců nacistického režimu? Zda existovalo specifické nacistické trestní právo? Jak toto právo vypadalo? Jaký byl obraz soudce ve Třetí říši? Jakým způsobem byl soudce ovlivňován při své rozhodovací činnosti ze strany nacistického režimu? Jak efektivní byla organizace německého trestního soudnictví mezi léty 1933 – 1945 především při stíhání odpůrců národně socialistického režimu?

Abstract:

The dissertation thesis "Development of criminal judicature in Germany 1933-1945" responds to following problems: How is it possible that german justice and german lawers joined nazi criminal regime and supported this regime in promotion its criminal policy and what were the main factors behind it? How was the role of legislator, jurisprudence, nazi ideology, status of justice in Weimar Republic and other factors like war, justice trial and individuality of a judge? How did the german judges participate in commited crimes and eliminating of opponents of nazi regime? Was there any specific nazi criminal law? What was this law about? What was the image of judge in the Third Reich? How was influenced the decision making process of judges by nazi regime? What was the effectivenss of criminal judicature in 1933-1945, escpecially in hunting opponents of national socialistic regime?
