Law and Sport - Legitimacy of Sport Rules

Abstract:

Sport i právo provází snad každého z nás po celý život. Tak tomu bylo již v dobách dávno minulých, a tak je tomu i nyní, v dnešním moderním svt. I když zde je namíst zdraznit, že právo se v historii objevuje podstatn pozdji než sportovní soutže a hry. Hra a soutživé prvky doprovází lidstvo od nepamti, kdežto právo vzniká až na uritém stupni vývoje spoleenského systému v okamžiku poteby regulovat existující spoleenské vztahy. O dležitosti sportu nejen v rámci Evropské unie svdí i následující výrok: Kluby a sportovní federace jsou souástí demokracie jsou-li správn využívány, stává se sport dobrou školou demokracie. Sport je píležitostí nauit se chování v kolektivu, píležitostí posilovat individuální i kolektivní schopnosti. Sport sám o sob mže fungovat jako zprostedkovatel, mže pomoci dát dohromady rzné kultury 25 lenských stát nov rozšíené Evropské unie. Takto charakterizoval sport , Jaime Andreau, šéf oddlení pro sport generálního editelství Evropské unie pro vzdlávání a kulturu, na konferenci s vševypovídajícím názvem Evropské kižovatky: Sport hlavní cesta k demokracii. Existuje ada oblastí a ada situací, v nichž se otázky sportu a práva prolínají. Když jsem zaala svou práci tvoit, napadalo m mnoho zpsob, jak ji pojmout a o em psát. Nechci se ale vnovat vztahm sportu a práva pouze v obecné rovin a snažit se obsáhnout vše, eho se daná problematika týká, s tím že výsledky budou pouze základní a teba i povrchní údaje. Mezi oblasti kde se ingerence práva do sportu projevuje v nejvtší míe patí bezpochyby otázky právní odpovdnosti ve sportu, oblast reklamy, sponzorství, daových úlev a financování sportu. Zajímavé jsou rovnž i úplatkáské aféry, o nichž se v poslední dob dozvídáme víc než je zdrávo i nap. problematika diváckého násilí nebo oblast pracovnprávních vztah ve sportu. Dle mého názoru každý z tchto okruh by si zasloužil být zpracován v jedné samostatné diplomové práci. Rozhodla jsem se tedy zmínit pouze nejdležitjší informace týkající se obecn vztahu sportu a práva, ponkud dkladnji rozebrat sportovní normy a v celé druhé ásti se dopodrobna vnuji problematice dopingu, dopingových pravidel a antidopingových institucí. Cílem této práce je tedy pokus o vytvoení uceleného pohledu na výše zmínné okruhy, s tím že se pedevším snažím zodpovdt na otázku, kde se bere legitimita sportovních norem, resp. antidopingových pravidel. Stranou není ponechána ani normativní úprava dané problematiky de lege ferenda.

Abstract:

My extended essay is about mutual relation between two normative systems sport and law. The main point of the first part of this work is term legitimity of sporting rules. Sport goes by sporting rules (it means rules granted by sports organisations intependently on state). This rules have to be in accordance to rules of law and the rules of law must be in accordance to purposes and mission of sport. Modern development of sport made that sporting activities cant be excluded out of action of law. There is the important function of legislation to be a control instrument of sporting relations. But there is necessary to adapt legislation on the specific conditions of sport. The second part (the main one) of my essay is about one of the biggest threats to contemporary sport. I chose the problem of doping, legitimity of antidoping rules, question of antidoping institutions. The use of performance-enhancing drugs and other doping agents destroys fair play and equitable competition, it harms athletes and it daoes irreparable damage to the credibility of sport. Simply doping destroys all that is good and noble about sport. I explain the term doping, its definition, aspects of doping and historical evolution. Extensive chapter is given antidoping institutions up. It means international non-governmental organizations, international governmental organizations (Council of Europe and European Union) and Czech institutions. The next part is about documents regulating the prohibition of doping. The most important documents are two international conventions European Antidoping Convention of Council of Europe and International Convention Against Doping in Sport of UNESCO. These international documents are very important because of doping regulation only by unlegal rules it isnt sufficient. The purpose of these conventions is to harmonise anti-doping efforts worldwide and to provide a legal framework within which all governments can také action to remove doping from sport. Until now, many governments couldnt be legally bound by a non-governmental document such as the World Anti-Doping Code, the document harmonizing regulations regarding anti-doping in all sports and all countries of the world. I mention the legislation and antidoping policy in deifferent states members of The Council of Europe. There are in some states anti-doping acts in force. Typical exemples are France and Italy. In the next group of states there is the antidoping policy in the competition of non-governmental institutions. And the last possibility of antidoping control it is the mixed systém it means cooperation of governmental and non-governmental organizations. The most important part of my work is about legal regulation of the points at issue of doping in Czech republic and about the necessity of mandatory regulation by state. There is only a partial regulation of this question in Czech republic. We can use some of the present valid legal regulations. But these regulations have to do with only some of the problematic points and only some of the forbiddent doping substances. Undoubtly it is necessary to accept new antidpoing law. The necessity of ongoing cooperation between governments and sport organizations in the fight against doping is the basic step to be successful.
