The rights and obligations of the parties involved in a road traffic accident to claim compensation for property damage against the insurer under compulsory liability insurance

Abstract:

Bakalářská práce se zabývá problematikou týkající práv a povinností účastníku dopravní nehody a následné likvidace pojistné události z pojištění odpovědnosti z provozu vozidla. Definuje aktéry, vyzdvihuje klíčové a problematické oblasti procesu, při kterých dochází k nejčastějším pochybením ze stran jak pojištěného, tak poškozeného. Přináší vhled do znalosti procesu zmíněných aktérů, jejich zmíněných práv a povinností při vzniku škodní události. Následně analyzuje problematické otázky, navrhuje konkrétní řešení k zajištění správného uplatnění práv a splnění povinností dotčených aktérů. Likvidace pojistné události z provozu vozidla je problematikou, se kterou doufá většina populace, že se nebude muset střetnout. Vzhledem k prudkému rozvoji mobility je však setkání se dopravní nehodou vysoké, a to nejen u řidičů. Je tedy důležité, aby populace byla o svých právech a povinnostech dostatečně informována a snížilo se tak snížilo množství negativních dopadů u zmiňovaných aktérů v důsledku pouhého zanedbání nebo nevědomosti.

Abstract:

The bachelor thesis deals with the issue of the rights and obligations of the participants in a traffic accident and the subsequent settlement of an insurance claim from the liability insurance of the vehicle. It defines the actors, highlights the key and problematic areas of the process in which the most frequent mistakes are made by both the insured and the injured party. Provides insight into the actors' knowledge of the process, their rights and obligations in the event of a claim. It then analyses the problematic issues, proposes specific solutions to ensure the correct application of the rights and fulfilment of the obligations of the actors concerned. The settlement of an automobile insurance claim is an issue that most of the population hopes not to have to face. However, due to the rapid development of mobility, the encounter with a traffic accident is high, and not only for drivers. It is therefore important that the population is sufficiently informed about their rights and obligations to reduce the negative impact on the aforementioned actors as a result of simple neglect or ignorance.
