Administration of Excise Duties on Mineral Oils

Abstract:

Cílem této práce je zevrubně čtenáře seznámit s východisky, které nabízí právní úprava spotřebních daní, především pak spotřební daně z minerálních olejů. V dalším textu práce je pozornost věnována rovněž ostatním povinnostem při nakládání s minerálními oleji, které jsou upraveny samostatnými právními předpisy z oblasti právní regulace užití pohonných hmot, jako jsou povinnosti z oblasti biopaliv a povinnosti distributorů pohonných hmot. Analýzou jednotlivých oblastí nakládání s minerálními oleji byla v uceleném textu této práce nabídnuta hodnocení a poskytnuty případné návrhy na změny právní úpravy de lege ferenda. Výsledkem této práce je pak především identifikace hlavních rizik a problémů plynoucích z nakládání s minerálními oleji jakožto předmětu spotřební daně a také předmětu právní úpravy nakládání s pohonnými hmotami.

Abstract:

The main objective of this this work is to get the reader to be familiar with the background of the excise duty, especially the excise duty on mineral oils. Further on, the attention is paid to the other obligations in management of THE mineral oils, covered by special legislation, e.g. the obligations in area of biofuels and the obligations of the fuel distributors. The work then, by analysis of specific areas of mineral oil management, is providing an evaluation of the current legislation and offers prospective proposals on changes to the rules de lege ferenda. The result of this work is then mainly the identification of major risks and problems arising from the management of mineral oils, as the subject of the excise duty and as the subject of law of fuel management.
