Abstract:

Téma diplomové práce zní Závěť po rekodifikaci soukromého práva. Aktuálnost tématu je dána rekodifikací základního kodexu civilního práva. Cílem práce bude analyzovat institut závěti dle zákona č. 89/2012 Sb. a za užití komparativní metody poukázat na změny oproti zákonu č. 40/1964 Sb. Pro rozsáhlost tématu se zaměřím na obsahové a formální náležitosti závěti. Zaměřím se i na zjištění, zda účinností občanského zákoníku byla posílena autonomie vůle zůstavitele z hlediska volnosti jeho rozhodování o svém majetku pro případ smrti. V úvodní části vymezím dědické právo, jeho zásady a předpoklady nabytí dědictví. Analyzuji institut závěti a vytyčím její pojmové znaky. Specifikuji obecné předpoklady pro způsobilost pořídit závěť. Náležitosti vůle pořizovatel a jejího projevu věnuji samostatnou kapitolu. Stěžejní část práce věnuji obsahovým a formálním náležitostem závěti. Esenciální obsahovou náležitostí je stanovení osoby dědicem, podrobně se však věnuji i určení podílu na pozůstalosti, náhradnictví, vedlejším doložkám závěti a negativní závěti. Zůstavitel může svou vůli projevit formou soukromé nebo veřejné listiny. Podrobně tedy přiblížím jednotlivé formy závěti, a to: holografní závěť, alografní závěť, notářský zápis a privilegované závěti.

Abstract:

The topic of this dissertation is Wills after the recodification of private law. The relevance of the topic is given by the recodification of the basic code of civil law. The aim of this dissertation is to analyse the institution of wills according to Act No.89/2012 Coll. and to point out the differences compared to Act No. 40/1964 Coll. using the comparative method. Due to the vastness of the topic, I will focus on the content and formalities of wills. I will also focus on determining whether the effectiveness of the Civil Code has reinforced the autonomy of the testator's will in terms of the freedom of his/her decision-making on his/her property in case of death. In the introductory part, I will define inheritance law, its principles and the requisites for the acquisition of inheritance. I analyse the institution of wills and set out its conceptual features. I specify the general requisites to eligibility to make a will. I devote a separate chapter to the particulars of the testator's will and his/her expression. The main part of the dissertation is devoted to the content and formalities of the will. An essential particular of the content is the designation of a person as an heir, but I also detail the process of determining the share in the inheritance, substitution, secondary clauses of the will and negative wills. The testator may express his/her will in the form of a private or public document. I will thus provide a detailed description of the various forms of wills, namely: the holographic will, the allographic will, the notarial record and the privileged will.
