Substitute custody in criminal procedures

Abstract:

Moje diplomová práce se zabývá nahrazením vazby v trestním řízení. V úvodní kapitole jsem vysvětlila několik základních pojmů. Především pojem vazba, důvody vazby, obecným předpokladům vazby. Poté jsem se zabývala tím, ve kterých případech je vazba, a současně i nahrazení vazby, vyloučeno. Nemohla jsem také vynechat pasáž o žádosti obviněného o propuštění z vazby na svobodu, neboť právě ve spojení s touto žádostí nejčastěji dochází k nahrazení vazby. V neposlední řadě jsem se také věnovala velmi diskutovanému problému k právu obviněného být slyšen při rozhodování o vazbě. V další kapitole jsem se věnovala vývoji vazby na našem území, se zvláštním zaměřením na historii nahrazení vazby. Tato práce si však nedávala za cíl hlubší historické zkoumání, ale jde spíš o jakýsi přehled vývoje od doby Rakousko-Uherska do tzv. velké novely trestního řádu. Těžiště mé práce je v popisu jednotlivých možností, kterými trestní řád umožňuje nahrazovat vazbu. U jednotlivých institutů jsem vždy nejprve popsala, kde a jakým způsobem jsou upraveny, rozebrala problémy, které přináší aplikační praxe a na tyto problémy hledala odpovědi v odborných článcích a především v rozsáhlé judikatuře obecných soudů, Nejvyššího soudu ČR, Ústavního soudu ČR, tak i v neposlední řadě v judikatuře Evropského soudu pro lidská práva. V rámci této kapitoly jsem zmínila i odlišnosti, které skýtá vazba mladistvých obviněných. V závěru jsem věnovala kapitolu srovnání naší úpravy s úpravou vazby a nahrazení vazby s našimi nejbližšími sousedy, tedy se Slovenskou republikou. Na úplný závěr jsem zvažovala úpravu vazby a nahrazení vazby de lege lata.

Abstract:

This is my thesis on substitute of custody in criminal procedures. The key terms, such as custody, reasons for custody, general conditions of custody, are explained in the first chapter. The cases in which custody and substitute custody are not possible are discussed in the next part of the thesis. I also could not have omitted the part about the plea of a defendant for release, for it is the most common reason for substitute of custody. The highly discussed problem of defendant's right to be heard during the decision making about custody follows. The next chapter focuses on the development of custody in our history, especially on substitute of custody. However, as the main purpose of the thesis is not deep historical research, it only shows the time development starting in the era of Austria ? Hungary and terminating with the so-called big ammendment of The Criminal Code. The essential part of the thesis lies in the description of possibilities which The Criminal Code accepts as substitutes of custody. These institutes are described in detail, as well as the problematics which the application practice brings. I found the solutions in various technical articles and in judicature of general courts, The Supreme Court of the Czech Republic, The Constitutional Court of the Czech Republic and The European Court of Human Rights. Different aspects of custody of juvenile defendants are also metioned in this chapter. The last chapter of the thesis compares approaches to custody and substitute of custody in the Czech Republic with the situation in Slovakia. In the very last part, adjustment of custody and substitution of custody de lege lata is considered.
