European Competition Network in the Perspective of European Integration

Abstract:

Práce na téma ECN v perspektivě evropské integrace se zabývá prosazováním ochrany hospodářské politiky podle článku 81 a 82 Smlouvy o Evropské unii, tzv. antitrustu. Cílem práce je analýza primárního a sekundárního práva, na kterém je tato politika založena, a politická analýza vztahů a procesů, které výkon antitrustu formují. Práce vychází z teoretického přístupu liberálního institucionalismu, který institucím přiznává vliv na iniciaci a formování politik. V práci bylo zjištěno, že governance antitrustové politiky je vykonávána na základě reformy, prostřednictvím tzv. „modernizačního balíku“, který vstoupil v účinnost v průběhu roku 2004. Součástí reformy se také stalo vytvoření mechanismu sítě ECN ve které jsou jednotlivý aktéři výkonu antitrustu na bázi dobrovolné spolupráce a výměny informací propojeni. Vůdčí pozici v síti zastává Komise, která se prosadila jako nejvyšší arbitr antitrustu a jako leader sítě vůbec. Prostřednictvím posuzování tzv. komunitárního prvku také reforma rozšiřuje jurisdikci komunitárního práva na i na jednání, teritoriálně omezená státními hranicemi. Závěr práce proto konstatuje posílení nadnárodní úrovně na úkor úrovně národní.

Abstract:

Thesis on the topic of ECN in the perspective of European integration deals with enforcement of economic policy protection according to the articles 81 and 82 in Treaty on European Union, so called antitrust. The goal of the thesis is analysis of relations and processes which form antitrust. Thesis comes from theoretical approach of the liberal institutionalism which gives to institutions the influence on initiation and formation of policies. In the thesis it was found out that governance of antitrust policy is executed on bases of reform, through so called “modernization packet” which entered in force in 2004. As a part of the reform was also mechanism creation of ECN network where are the participants of antitrust on bases of voluntary cooperation and information exchange about interconnections. Leadership position has Commission, which became the highest arbiter of antitrust. Through assessment of so called community element reform also extends jurisdiction of community law for conduct, territorially limited by national borders. In the conclusion is stated reinforcement of supranational level at the expense of national level.
