Administrative Discretion in Administrative Punishment

Abstract:

Práce podává jednak stručný pohled na problematiku správního uvážení obecně, jednak konkrétnější vymezení správního uvážení ve vztahu ke správnímu trestání. Správní uvážení lze chápat jako nepostradatelný prostředek pro výkon veřejné správy, který umožňuje její reagovávání na proměnlivost situací či regulovaného prostředí a který tak zajišťuje její efektivní fungování. Správní uvážení je spjato s veškerými činnostmi veřejné správy, jeho místo je tam, kde správní orgán provádí výběr minimálně ze dvou variant. Nejobtížnější fází uvažování je nepochybně nalezení veškerých jej ovlivňujících hledisek, včetně obecných právních principů a hodnot. Právě tato vyšší, obecná hlediska vedou správní orgán k tomu, aby zohlednil všechny podstatné aspekty určitého případu, byť na ně zákonné ustanovení uvádějící konkrétní hlediska pro stanovení druhu a výměry sankce samo nepoukazuje. Jedině respektováním veškerých hledisek lze totiž zajistit náležitou ochranu veřejných subjektivních práv, která jsou výsledným správním rozhodnutím dotčena, a dosáhnout takového rozhodnutí, které naplňuje požadavky na jeho správnost a spravedlnost. Závěrem práce jsem se věnovala kontrole správního uvážení, především jeho soudnímu přezkumu.

Abstract:

In my thesis I try to define the basic features of administrative discretion and explain its application in punishment of administrative delicts. Discretion is defined as the power of the administrative authority to make choice between at least two options of decision. I explain that this power must be understood as the obligation to use consideration. The administrative body should be able to give reasons for the chosen course of action. I shortly deal with binding and freedom in decision making processes, the limits of discretion and its criteria. Afterwards I concentrate on the interpretation of the concept of equitable penalty on account of an administrative delict and determine some presumptions for its imposition. I analyze in detail the criteria affecting administrative discretion by imposing a sanction. The appointing authority should take into account all the particular facts and circumstances peculiar to each individual case, which can be indicated as factual criteria. Moreover, there are some „higher“ criteria, which are of great importance for consideration of the administrative body. I try to define these standards and describe the distinction between legal principles and values and legal norms. The last part of my thesis describes the control of administrative discretion.
