The Exhibition as a Collective Work

Abstract:

Předmětem této diplomové práce je výstava jako dílo souborné chráněné autorským právem. V první části se práce zaměřuje na jednotlivé pojmové znaky děl souborných, konkrétně na jedinečnost výsledku tvůrčí činnosti autora výstavy, na subjekt autorského práva k výstavě a na libreto výstavy jako její vyjádření v objektivně vnímatelné podobě. Dále se práce zabývá uspořadatelskou tvůrčí činností vedoucí ke vzniku výstavy a jejím samotným obsahem z hlediska jeho autorskoprávní povahy. Ve druhé části práce rozebírá rozhodovací činnost soudů v případech, jejichž předmětem byly výstavy, a to jak z české, tak i německé soudní praxe.

Abstract:

The subject matter of this thesis is the exhibition as a collective work protected by copyright. The first part of the thesis focuses on individual conceptual features of collective works, in particular the uniqueness of the result of the creative activity of the author of the exhibition, the subject of the copyright to the exhibition, and the libretto of the exhibition as its expression in an objectively perceivable form. Furthermore, the thesis concerns itself with the organizational creative activity leading to the creation of the exhibition and its content itself in terms of its copyright nature. The second part of the thesis analyses the decision-making activity of courts in cases involving exhibitions, both from the Czech and the German judicial practice.
