Abstract:

Téma diplomové práce náhrada škody při porušení autorských práv je velmi obsáhlé a pokusil jsem se jej v této práci co nejobšírněji popsat. Vzhledem k tomu, že jsem se tématem dlouhodobě zabýval, myslím si, že odkazující úprava v autorském zákoně v § 40 odst. 4 je odkazem nanejvýše vhodným a logickým. Nevyvratitelná právní domněnka autorského zákona je také vhodným prostředkem k určení výše ušlého zisku. Úprava náhrady škody v občanského zákoníku je již dlouhou dobu naplňována právě jak teorií, tak praxí a myslím si, že vhodným způsobem. Ovšem vzhledem ke studiu tohoto tématu jsem si nemohl nevšimnout základního rozdílu mezi obecnou právní úpravou občanského zákoníku a úpravou odpovědnosti za škodu vzniklou autorovi zásahem do autorského práva, který spočívá právě ve skutečnosti, že ve vztahu k zásahu do autorského práva zákon nevyžaduje zavinění, ačkoliv v obecné úpravě občanského zákoníku je zavinění jedním z předpokladů náhrady škody. Tato diplomová práce shrnuje veškeré poznatky, které jsem při jejím zpracování učinil a především ukazuje podstatné rozdíly mezi úpravou obecnou a zvláštní, tedy kdy autorský zákon odkazuje ve své podstatě na obecné znění o náhradě škody občanského zákoníku.

Abstract:

The topic of this thesis, damages for copyright infringement, is very extensive and this thesis describes it as broadly as possible. Given that I have dealt with the topic for a long time, I think that referring regulation in copyright law in Section 40, paragraph 4, is extremely appropriate and logical. The incontrovertible legal presumption of copyright law is also an appropriate means of determining the amount of lost profit. The adjustment of compensation in the Civil Code has been implemented for a long time both in the theory and practice. This is in my opinion appropriate. However, due to the study of this topic I could not miss the distinction between the general legislation and regulation of the Civil Code and the regulation of liability for loss or damage ensued to the author by the interference with the copyright, which rests precisely in the fact that the law does not require the fault in relation to the interference with the copyright law, although in the general arrangement of the Civil Code, the fault is of one of the prerequisites of damages. This thesis summarizes all the information that I have achieved during its processing and shows significant differences between the general and specific regulation, that is, that the Copyright Act refers in essence to the general wording of the Civil Code damages.
