Abstract:

Bakalářská práce je rozdělena do pěti kapitol. V první části se práce zaměřuje na odlišení významu pojmů kvalita a jakost, dále vymezuje základní pojmy spojené nejen s ekonomickou, ale i právní tématikou. V následující části se práce věnuje exkurzu do historie uplatňování záruk v historii. Třetí kapitola pak mapuje historii uplatňování záruk. Popisuje funkce norem ISO a cestu, jak této certifikace dosáhnout z postavení firmy, také popisuje úpravy, které se zabývají problematikou záruk a vymezení vad s jejich odpovědností. V poslední kapitole práce popisuje lhůty a podmínky pro uplatnění záruk formou reklamací. Proces reklamace je představen jednak z pozice spotřebitele, jednak z pozice podnikatelského subjektu. V závěru se práce zmiňuje dozorové orgány a jejich činnost. Cílem bakalářské práce je analyzovat právní úpravu v otázce vadného plnění vzhledem k nově platnému občanskému zákoníku spolu s implementací směrnic Evropské unie.

Abstract:

Bachelor thesis is divided into five chapters. The first part of bachelor thesis is focused on distinction between terms „quality“ and „grade“. Furthermore basic terms related to economical as well as legal topics are defined. The following part deals with historical making warranty claims. The third chapter surveys the history of making complaints. The functions of ISO standards are described together with the way of achieving such standards by companies. Further the legislation dealing with the issue of guarantees and specification of defects liability are discussed. The last chapter describes the terms and conditions for the guarantees application using warranty claims. The complaint process is shown both from consumer and company point of view. The final part concerns to supervisory bodies and their activities. The aim of this thesis is analysis of legislation regarding defective performance due to new Civil code in force together with European Union directives implementation.
