Investigating Insurance Fraud

Abstract:

Diplomová práce pojednává o problematice související s pojistnými podvody v naší společnosti. Je zpracována takovým způsobem, aby mohla být použita studenty jako materiál do odborných předmětů, ale může také informovat širokou veřejnost. Celá práce je rozdělena do několika tematických kapitol. První kapitola přibližuje historii pojišťovnictví. Následující kapitola je věnována pojmu pojistný vztah a jeho charakteristice. Další části práce jsou věnovány problematice týkající se pojistného podvodu, jeho druhy, právní úpravy a klasifikace, způsoby páchání pojistného podvodu jak u životního, tak i neživotního pojištění. Dále je práce zaměřena na podněty k vyšetřování a kriminogenní faktory, typické vyšetřovací situace a dokazování pojistných podvodů a v neposlední řadě i na charakteristiku pachatelů. Praktická část je zaměřena na odhalování této trestné činnosti v praxi, prevenci a statistické shrnutí vyšetřovaných pojistných podvodů v letech 2013 2016. V závěru práce je uvedeno pět příkladů z odhalených pojistných podvodů, které byly páchány lékaři, u komerčních pojišťoven a pět příkladů z odhalených pojistných podvodů u pojišťoven zdravotních.

Abstract:

This Master's thesis deals with insurance frauds in our society. This thesis was elaborated in such a way that the data can serve both to students for educational purposes and to inform general public. This thesis is divided to several chapters: The first chapter is specifically dedicated to history of insurance industry. The very next chapter deals with term instance relationship and its characteristics. The following chapters are dedicated to insurance frauds, its types, laws and regulations and classifications, the ways how the fraud can be committed on examples of both life and non-life insurance. This thesis is also focused on initiative, impulses for investigation such frauds, criminogenic factors, typical investigational scenarios, proving insurance frauds and last but not least, the characteristics of per petrators. The practical part is focused on revealing this criminal activity, its prevention and statistical summary of investigated insurance frauds between years 2013-2016. In the final part of this thesis is demonstrated five real examples of proven insurance frauds which were committed by doctors who were clients of commercial insurance companies and another fire real examples of proven insurance frauds with life insurance companies.
