The Concept of Rape

Abstract:

Znásilnění je trestným činem, jenž může být definován různě. Stále však obsahuje dvě základní složky, kterými jsou sexuální spojení a neexistence konsenzu. Tato práce je zaměřena na vnitřní členění konsenzu jako právního jednání a z něho plynoucích okolnosti, jež mohou znamenat rozdíl mezi „milostným aktem“ a znásilněním. Tyto okolnosti jsou názorně předvedeny na reálných případech a v závěru srovnány s českou právní úpravou. Práce představuje důležitý pohled nejen na samotný pojem znásilnění, ale i na sexuální vztahy a okolnosti souhlasu.

Abstract:

The rape is a criminal offense that can be defined in many different ways. It still contains two basic components, which are a sexual union and the absence of consent. This thesis is focused on the internal division of consent as legal negotiations and the inherent circumstances, which may mean the difference between "the act of love" and the rape. These circumstances are clearly illustrated on real cases and they are compared with the Czech legislation in the end. The thesis represents an important view not only on the concept of rape itself but also on sexual relationships and on circumstances of consent.
