Influence of Superficial Principle on Land Registr

Abstract:

Diplomová práce Vliv superficiální zásady na katastr nemovitostí se zabývá opětovným zavedením principu, že stavba je součástí pozemku do českého právního řádu. Dále popisuje jednotlivé instituty, které souvisí s principem superficies solo cedit a propojuje právní úpravu občanského práva a katastrální předpisy. Práce se zaměřuje na vývoj evidence nemovitostí a podstatnými změnami, které přinese zákon č. 89/2012 Sb., nový občanský zákoník. Ke konci práce se autorka věnuje především hodnotícím úvahám a nastiňuje možnosti řešení právních situací nastalých při aplikaci superficiální zásady z hlediska katastru nemovitostí.

Abstract:

Hereby presented diploma thesis Influence of Superficial Principle on Land Registry deals with recurring introduction of the superficial principle, which states that “a building is a component of land” into Czech legal system. The thesis describes important institutes, which are connected to the superficial principle. It also covers the development of property evidence and substantial changes that the new civil code (89/2012 Sb.) will introduce. At the end of the thesis the author presents evaluating reasonings and outlines possibilities of solutions that may arise during application of the superficial principle on land registry.
