Abstract:

Práce se zabývá aplikací platné právní úpravy zákona č. 361/2003 Sb., o služebním poměru příslušníků bezpečnostních sborů v praxi. Zaměřuje se na vznik, změny a skončení služebního poměru příslušníků a porovnává je s praktickými zkušenostmi. Na popisu konkrétní kauzy demonstrující služební praxi poukazuje na nedostatečnou právní úpravu a procesní nedostatky při řízení o propuštění příslušníka ze služebního poměru v případě pozbytí jeho zdravotní způsobilosti. Práce uvádí právní, ekonomické a společenské aspekty tohoto stavu. Práce se věnuje řešení problému a v závěru zaměřuje pozornost na připravovanou novelizaci vyhlášky č. 226/2019 o zdravotní způsobilosti ke službě v bezpečnostních sborech, která by měla současný právní nedostatek narovnat.

Abstract:

The thesis deals with the application of the valid regulation of Act no.. 361/2003 Sb about the service of security corps officers in practice. It focuses on the beginning of, the changes to, as well as the termination of a corps officer’s service and further compares these with practical experience. By making use of the description of a particular case of service practice it refers to the insufficient legislation and procedural shortcomings during the service cancellation procedure in the case of the concerned officer’s loss of medical fitness for work. The thesis indicates legal, economic and social aspects of this state. The thesis is dedicated to solving the indicated problem. In the final part it focuses on the forthcoming amendment of ordinance no. 226/2019 about medical fitness for security corps service, which should settle the current legal weakness.
