Specifikation of Preliminaries Criminal Proceedings Against Young Offender, Which in The Course of Preliminaries Proceedings Acquired Legal Age

Abstract:

Diplomová práce se zabývá přípravnou fází trestního řízení, do podání obžaloby v řízení proti mladistvému pachateli, který v průběhu přípravného řízení nabyl zletilosti. O trestním řízení ve věcech mládeže bylo napsáno mnoho odborné literatury, studentských prací a mnoho odborných článků. Samozřejmě jsou mezi nimi i zákony a komentáře k zákonům. Dostupné publikace se především zabývají trestním řízením mladistvých nebo společným řízením proti mladistvému a dospělé osobě nebo rozdíly mezi trestním řízením mladistvých a trestním řízením dospělých. Chybí však odborná literatura, která by se zabývala specifikací trestního řízení proti mladistvému pachateli, který v průběhu přípravného řízení trestního, nabyl zletilosti. Hlavním cílem práce je upřesněný a prohloubený výklad specifických rozdílů trestního řízení proti dospělé osobě z provinění, tedy osobě, proti které se trestní řízení vede jako proti mladistvé osobě a která v průběhu trestního řízení přípravného nabyla zletilosti. Diplomová práce reaguje na absenci judikatury odborné literatury a komentářů ve věcech mladistvých pachatelů, kteří v průběhu řízení nabyli zletilosti a přispívá tak do oblasti trestního práva, neboť její zpracování co nejvíce přihlíží k potřebám praxe a dobře poslouží odborné veřejnosti a zejména policistům, kteří s obdobným případem, kdy mladistvý před zahájením trestního stíhání dospěje, se v budoucnu setkají. Stěžejní metodou je proto studie odborné literatury, zákonů, aktuální i historické tuzemské judikatury a následné zpracování získaných informací s cílem přiblížit a analyzovat danou problematiku.

Abstract:

The thesis deals with preparatory stage of the criminal proceedings, until the moment of filing an action in the proceedings against a juvenile offender, who came of age during the preparatory proceedings. Lots of professional literature, student works and many expert articles have been written on criminal proceedings in cases of the youth. They include of course also laws and commentaries on laws. Available publications deals in particular with criminal proceedings of the youth or common proceedings against a juvenile and an adult person or differences between criminal proceedings of young persons and criminal proceedings of adults. However there is no professional literature here dealing with specification of the criminal proceedings against a juvenile offender, who came of age during the preparatory criminal proceedings. Main objective of the thesis is specified and deepened interpretation of specific differences of criminal proceedings against an adult person from misdemeanor, thus the person, against which the criminal proceedings are conducted as against a juvenile and who came of age during the preparatory criminal proceedings. The thesis responds to absence of judicature, professional literature and commentaries in cases of juvenile offenders, who came of age during the proceedings and thus it contributes to the area of criminal law since it takes into account as much as possible the needs of practice and it will serve well to the professional public and in particular to the police, who will encounter in future a similar case, where a juvenile comes of age before commencement of the criminal prosecution. Crucial method is therefore study of professional literature, laws, current and historical national judicature and subsequent processing of obtained information with the aim to explain and analyze the given issue.
