Termination of Obligations by Set-off

Abstract:

Tato diplomová práce je věnována úpravě právního institutu započtení v rámci nového občanského zákoníku. Cílem této práce je vymezit sporné otázky, jenž vyvstaly s novou právní úpravou započtení a v kontextu historického vývoje a dosavadní rozhodovací praxe Českých soudů se pokusit na ně najít uspokojívé odpovědi. Práce rovněž obsahuje srovnání hlavních odlišností tuzemské úpravy započtení s úpravou obsaženou v Návrhu společného referenčního rámce (DCFR).

Abstract:

This thesis deals with the regulation of the legal institution of set-off under the new Civil Code. The aim of this work is to define the issues that have arisen with the new legislation of set-off in the context of historical development and current decisional practice of Czech courts and try to find a satisfactory answer Work also includes a comparison of the main differences between domestic offsetting regulation with the regulation contained in the Draft Common Frame of Reference (DCFR).
