Constitutional Conventions

Abstract:

Diplomová práce se věnuje problematice ústavních zvyklostí, jejich teoretickému uchopení odbornou veřejností jak v zemích anglo-americké právní kultury, tak i v zemích právní kultury kontinentálně-evropské, s důrazem na české právní prostředí. Cílem práce je vytvoření pevného teoretického základu jejich rozpoznávání a přijetí jejich neprávních účinků. V úvodní kapitole se práce zaměřuje na rozbor přístupů v zemích common-law. Z těchto přístupů pak vyvozuje vlastní teoretické pojetí. V další kapitole je představena praktická aplikace ústavních zvyklostí Nejvyšším kanadským soudem v rámci sporu o patriaci. Kapitola se dále zaměřuje i na vliv existujících zvyklostí na změnu psané právní ústavy. Poslední část práce detailněji popisuje český přístup k problematice ve smyslu uchopení teoretického i judikaturního. Celou prací prostupuje kritika stávajících přístupů z pohledu autorem navržené doktríny.

Abstract:

The thesis deals with constitutional conventions in the common-law and civil-law legal doctrine. The aim of the thesis is to establish a firm theoretical ground for the recognition of conventions and the acceptance of their non-legal effects. In the introductory chapter the thesis analyses the common-law doctrine and develops its own theoretical understanding of constitutional conventions. In the next chapter the practical application of constitutional conventions by the Supreme Court of Canada during the Problem of Patriation is presented. This chapter also focuses on the impact of current conventions on the black letter law amending procedure. The very last part of the thesis describes in detail the understanding of constitutional conventions in the Czech republic both in the doctrine and the case law. Finally, the author proposes his own theory of constitutional conventions.
