Racial discrimination and xenophobia in France and EUs reflection on this issue

Abstract:

Podle zprávy Amnesty International je Evropa v současnosti domovem 10-12 milionů Romů. Mnoho z nich žije pod každodenní hrozbou nuceného vystěhování, policejního obtěžování a násilných útoků. K nucenému vystěhování ze země došlo v roce 2010 ve Francii. Kontroverzní politika Nicolase Sarkozyho, jež počítala s vyklizením nelegálně zřízených romských táborů na předměstích francouzských měst a následnou deportací jejich obyvatel do Rumunska a Bulharska, se setkala s kritikou EU. Francie jako zakládající stát Unie svým počínáním porušila nejen primární a sekundární právo EU, ale postavila se proti duchu a stanovám EU samotné. Právě případ Francie její diskriminační, rasistické a xenofobní chování vůči Romům v roce 2010 a role EU, především tedy role Evropské komise, v oblasti práv menšin je tématem této diplomové práce. Cílem práce je analýza jednání mezi institucemi a aktéry Evropské unie a Francie a identifikace kauzálních mechanismů, které vedly k tomu, že i přesto, že Francie porušila právo Unie, Evropská komise nepodala žalobu pro porušení povinnosti k Soudnímu dvoru EU.

Abstract:

There are between 10 million and 12 million Roma in the EU. They are disproportionally affected by discrimination and violence. This thesis focus on case, which has become known as Roma affair. In summer 2010 the French government expelled almost 1,000 Romanian and Bulgarian nationals of Roma origin living in France. President Nicolas Sarkozy and the French invoked a threat to the identity of the French society in order to legitimize the ensuing collective expulsions. French policy was an example of infringement of EU law. The European Commission is responsible for indentifying violations of EU laws. If a violation has occurred, the Commission is responsible for guaranteeing member state compliance through its infringement procedure. The aim of this thesis is to analyze the negotiations between institutions and actors of the European Union and France, and also identify causal mechanisms that led to the fact that the European Commission didn´t take a legal action againts France, despite the evidence of violation of EU law by this member state.
