Criminal liability for sports injuries

Abstract:

Sport, činnost, která je součástí životů většiny z nás, a to alespoň určitým specifickým způsobem. Jeho spojení s oblastí práva však není záležitostí, která by byla častým či aktuálním předmětem diskuzí. Tato rigorózní práce pojednává o propojení oblasti sportovního práva s právem trestním, o jeho vztahu ke sportovním úrazům, a přináší odpověď na otázku, zda je vůbec možné shledat trestní odpovědnost sportovce, a jak je na ni nutno nahlížet při aplikaci trestněprávních norem. Podstatnou část tvoří analýza rozhodnutí českých soudů, a to nejen těch, jež jsou uveřejněna v běžně dostupných databázích. Jsou zde totiž analyzována také rozhodnutí českých soudů, které nemají povinnost svá rozhodnutí uveřejňovat, případně v době jejich vydání tuto povinnost neměly. Za součinnosti státních zastupitelství se podařilo i taková rozhodnutí získat. Rigorózní práce vytváří ucelený pohled na souvislosti oblasti sportovní a trestní a obsahuje možná řešení sporných otázek, které vznikly z důvodu málo četné rozhodovací praxe.

Abstract:

Sport is an activity that is, at least in some way, part of the life of nearly every single human. The relationship between sport and law is not a frequently discussed topic. The rigorous thesis discusses the connection between the field of sports law and criminal law and its relation to sports injuries. The thesis answers whether it is possible to find a criminal liability of sportsmen and how the liability should be considered when applying criminal law. A substantial part of the thesis consists of an analysis of the Czech courts’ rulings. Also, not commonly available rulings were analysed. The thesis also considers rulings of Czech courts that are not obliged to publish the rulings or were not obliged to publish the rulings at the time of the publication. With the cooperation of the prosecutors' offices also such rulings were obtained. The rigorous thesis brings a coherent overview of the relationship between sports and criminal law as well as brings possible solutions to controversial topics that have arisen due to limited decision-making practices.
