Abstract:
Tato diplomová práce se zabývá tématem utvrzení dluhů podle účinné právní úpravy v novém občanském zákoníku. V práci jsou nejprve koncepčně vymezeny pojmy utvrzení a zajištění dluhu, dluh a závazek. Druhá kapitola se zabývá institutem smluvní pokuty a srovnává její úpravu v občanském zákoníku, obchodním zákoníku a v novém občanském zákoníku. Abstract:
The diploma thesis deals with the topic of confirming a debt according to the new civil code. Firstly the terms closely related to the confirming a debt are defined. The second chapter concerns with the issue of contractual penalty and compares its regulation in civil code, commercial code and new civil code.
