Abstract:

ABSTRAKT Diplomová práce porovnává druhy trestů v trestním řízení a přestupkovém řízení, a to i z pohledu jejich možného kombinování a uplatňování v praxi. Jejím cílem je tresty obecně popsat, porovnat podmínky pro jejich uložení a porovnání podmínek vyhodnotit. Vyhodnocení je provedeno porovnáním konkrétních vybraných trestných činů a korespondujících přestupků. Na základě zjištěných skutečností se autorka pokusila navrhnout možné změny v ukládání trestů tak, aby bylo dosaženo jejich větší efektivity, zejména z pohledu nápravy pachatele a omezení páchání protiprávní činnosti v budoucnu. Práce se nejdříve zabývá stručným popsáním historie trestů a vysvětlením základních pojmů. Následuje popis jednotlivých trestů a zásad pro jejich ukládání, nejprve trestů ukládaných podle trestního zákona, a poté podle přestupkového zákona, což tvoří nejrozsáhlejší část práce. V další části jsou pak tři vybrané trestné činy a přestupky, u kterých je provedeno porovnání trestů, které za ně lze uložit. Následující, závěrečná část práce, je pak věnována obecnému zhodnocení možností sankcionování v obou právních odvětvích a na základě provedeného srovnání se autorka zamyslela nad možnými návrhy de lege ferenda, které by dle jejího názoru mohly přispět k větší účinnosti uložených trestů. Tedy k tomu, aby tresty měly skutečně požadovaný účinek na pachatele, omezily další páchání protiprávní činnosti a zároveň více působily na nápravu pachatele a také více působily preventivně na veřejnost.

Abstract:

ANNOTATION The thesis compares the types of punishments for crimes and misdemeanors, including their possible combination and application in practice. Its aim is to describe the punishments in general, to compare the conditions for their imposition and to assess the comparison of these conditions. The assessment is performer by comparing specific selected punishments and corresponding misdemeanors. Based od the findings, possible changes are proposed in the imposition of punishments in order to achieve better efficiency, especially in terms of improving perpetrator’s behavior and prevention of illegal aktivity in the future. At first, the thesis deals with the history of sentencing and explains some basic terms. It is folowed with the description of individual punishments and the principles for their imposition, at first the punishments imposed under the Criminal Code and then, under the Misdemeanor Act, which forms the most extensive part of the thesis. In the next part, three selected crimes and misdemeanors are compared, also the comparison of punishments that can be imposed for them is made. The following, final part of the thesis is devoted to the assessment of the possibilities of sanctioning in both branches of law, and based on the comparison, the author considered possible amendments de lege ferenda laws, which in her opinion could contribute to a better educational and repressive purpose of the imposed sentences in order for them to have a real and desired effect on the perpetrators, that is to reduce the perpetration of crimes more effectively, to have a greater effect on the perpetrator’s correction, and to have more preventive effect on the public.
