Abstract:

Diplomová práce se zabývá problematikou spotřebitelského úvěru. Práce analyzuje českou právní úpravu spotřebitelského úvěru a dále analyzuje vývoj právní úpravy a porovnává její změny a celkově ji hodnotí a to také z hlediska ochrany spotřebitele. Jsou jmenovány největší změny, které přináší NOZ a tyto změny jsou hodnoceny, zda přispívají k ochraně spotřebitele, či ne. Podobným způsobem je zmapován i vývoj zákona o spotřebitelském úvěru a jeho novelizace.Dále diplomová práce porovnává vybrané bankovní a nebankovní poskytovatele spotřebitelských úvěrů. Jak bankovní tak poté nebankovní subjekty jsou nejprve stručně představeni, poté jsou popsány jejich služby a nakonec je zpracován i praktický případ, kdy si osoba bere fiktivní spotřebitelský úvěr a to na základě podmínek, které daný poskytovatel nabízí.

Abstract:

The theme of dissertation is "consumer credit". The thesis analyzes the czech legal regulation of consumer credit and also analyzes development of the legal regulation and compares its changes during the time and evaluates the legal regulation in terms of consumer protection. Thesis mentions the biggest changes brought NOZ and these changes are evaluated by whether they contribute to consumer protection or not. In a similar way, we charted the development of the Consumer Credit Act and its amendment. Furthermore thesis compares selected bank and non-bank providers of consumer credit. Both bank and nonbank entities are first briefly described, then are their services included and finally there is a practical case presented. The practical case is based on the terms and conditions which are provided by the consumer credit provider.
