Probation and mediation in penal justice

Abstract:

Téma této závěrečné práce se nazývá Alternativní tresty v agendě Probační a mediační služby se zaměřením na trest obecně prospěšných prací. Cílem závěrečné práce je popsat odborné činnosti PMS a vytvořit ucelený přehled o jednom z alternativních trestů PMS ČR – obecně prospěšných prací. K tomu, aby bylo dosaženo cíle, kterého jsem si stanovila, bylo zapotřebí prostřednictvím odborné literatury vysvětlit základní pojmy. Jedná se například o pojmy probace, mediace, restorativní justice, alternativní tresty a mnoho dalších. Jednotlivé kapitoly se blíže zabývají historií PMS, představením PMS, pojmy probace, mediace, principem restorativní justice, činnostmi PMS a v neposlední řadě také jednotlivými agendami PMS. Závěr práce je věnován kazuistikám, které bylo přínosné zařadit do této práce. Kazuistiky jsou zaměřeny na problematiku trestu OPP. V první kazuistice se jedná o klienta, který se pokouší o nápravu svého chování, pravidelně navštěvuje PMS a trest OPP se snaží plnit. V druhé kazuistice se jedná o případ klienta, který nevykazuje známky snahy o nápravu škod ani svého chování, nenavštěvuje PMS a trest OPP neplní.

Abstract:

The topic of the final thesis is the Alternative punishments within the Probation and Mediation Service, with a focus on punishment of community service. The aim of the thesis is to describe the professional activities of PMS and create a comprehensive overview of one of the sentences PMS - community service. In order to achieve the goals that I set was required by the professional literature to explain the basic concepts. These include the terms of probation, mediation, restorative justice, alternative punishments and many others. Individual chapters deal with the history nearer PMS, PMS performance, notions of probation, mediation, restorative justice principles, activities, PMS and last but not least, the agendas PMS. The conclusion is devoted to case reports, which were valuable to include into this work. Case reports are focused on the issue of community service. In the first case report of a client who is trying to correct his behavior, regularly attends Probation and Mediation Service and sentenced to community service tries to perform. In the second case study is a case of a client who shows no signs of attempts to repair the damage or their behavior, not attending Probation and Mediation Service and punishment OPP are not met.
