The funds of qualified investors in the Czech Republic

Abstract:

Práce se zabývá vývojem fondového byznysu v České republice, a to zejména vývojem fondů kvalifikovaných investorů (dále jen „FKI“) po zavedení účinnosti nového zákona o investičních společnostech a investičních fondech (dále jen „ZISIF“), který nahradil zákon o kolektivním investování. Cílem mé práce je zjistit, jak tato nová právní úprava přispěla k zatraktivnění fondového průmyslu v České republice, jak se zvýšila popularita investičních fondů, resp. FKI u investorské veřejnosti, zejména v souvislosti s podílem jejich investic do FKI vůči jejich celkovému majetku. V první části je poukázáno na hlavní změny, které nový zákon v oblasti kolektivního investování přinesl, jaké je nové členění investičních fondů a jaké subjekty se podílí na jejich provozu. Druhá část podrobně popisuje fondy kvalifikovaných investorů jakožto subkategorii investičních fondů, jaké požadavky jsou kladeny na zakladatele fondů při jejich zakládání, kdo je investorem fondů a jaké aspekty jsou spojeny s jejich nabízením veřejnosti. Ve třetí části je pak analyzována struktura majetku české veřejnosti v porovnání se zbytkem světa, vývoj majetku českých investorů v investičních fondech, resp. FKI po roce 2013 a jaká je investiční strategie současných FKI v ČR.

Abstract:

This thesis deals with development of fund business in the Czech Republic, especially development of Funds of qualified investors (FKI) after implementation of the new Act on Investment Companies and Investment Funds, which replaced Act on Collective Investment. The aim of this thesis is to examine the contribution of this legislation change to the attractiveness of the Czech environment for setting up new funds of qualified investors (FKI) and how popular these funds became among the public, especially in relation to their investments in FKI compared to individual aggregate wealth. The first section points out the most important changes brought by the new collective investments legislation, what is new categorization of investment funds and which legal entities are involved in fund operation. The second part specifies in detail funds of qualified investors as a subcategory of investment funds, requirements on the founders during setting up a fund, investors themselves and issues related to the distribution. The third segment analyses structure of Czech investors’ assets in relation to the rest of the world, dynamics of their investment volume in investment funds, and FKIs respectively, after 2013 and investment strategies of FKIs available in the Czech Republic.
