Modification of the 3rd pillar of the pension system by a transition from a supplementary pension insurance to pension savings

Abstract:

Penzijní připojištění se státním příspěvkem je významnou součástí III. pilíře penzijního systému. Jeho provozovatelé – penzijní fondy – však nesou ze zákona obě rizika: riziko investiční i riziko výplaty dávek. Kromě toho stojí před nutností tzv. „oddělení“ majetku účastníků a akcionářů. Tyto tři zásadní požadavky regulátora je nutné doplnit poznatky z fungování systému. Vysoký počet klientů je snad jediným pozitivním rysem. Proti tomu stojí fakt, že cca 85 % účastníků si platí měsíční příspěvek 500 Kč nebo nižší, resp. 85 % účastníků, kteří ukončili spořící fázi, žádají o jednorázové finanční vyrovnání a ne o výplatu doživotní penze. Systém tedy dosud svoji úlohu neplní a není naděje na obrat k lepšímu. Za těchto okolností lobby penzijních fondů navrhla transformační zákon, který by v podstatě umožnil převést významnou část kmene účastníků penzijního připojištění z tvrdě regulovaného režimu, vynucujícího kladný hospodářský výsledek, na mnohem liberálnější režim penzijního spoření. V něm by obě rizika – investiční i výplatu dávek – nesli účastníci. Příslušný vládní návrh zákona však Poslanecká sněmovna Parlamentu České republiky odmítla na prosincové schůzi projednávat. Návrh zákon byl pozoruhodný akcentem na kolektivní investování. Proto bude zajímavé srovnat oba zákony – zákon o penzijním připojištěni proti zákonu o penzijním spoření především v tomto ohledu.

Abstract:

The pension supplementary insurance with state contribution is a considerable part of the 3rd pillar of the pension system. Its providers - pension funds - are responsible in terms of the statutory regulations for both of the risks: the risk of an investment strategy as well as the risk of benefit payments. Besides there is the necessity of separation of shareholders and clients estates. Findings from the operating conditions must be integrated in these three regulator’s basic requirements. A high number of clients seems to be the only positive feature. But there is the fact that about 85% clients contribute monthly 500 CZK or less, or 85% clients after finishing of a saving stage submit for a lump-sum settlement instead of payments of life old-age pension. Tasks of the system are not fulfilled yet and there is no hope for turn for the best. Within the frameworks of such circumstances the pension funds lobby drew up the Act of transformation allowing in essence to transfer an important part of clients of pension funds from the strictly regulated mode in which a fund must provide favourable output to a much more liberal mode of pension savings. In such a mode clients face the both risks - investment as well as pension payments. The Chamber of Deputies of the Parliament of the Czech Republic on its December session refused to discuss the bill. The bill was remarkable in emphasizing of the collective investment. That’s why, concerning this point of view, it is interesting to compare both laws - the act on supplementary pension insurance to the bill on pension savings particularly.
