Building from the perspective of the Land Registr

Abstract:

Bakalářská práce pojednává o aktuálních problémech spojených s evidováním budov v katastru nemovitostí, a to zejména v souvislosti s účinností nového občanského zákoníku, nového katastrálního zákona a jeho prováděcí vyhlášky. V úvodu práce jsou stručně shrnuty právní předpisy týkající se evidování budov, poté je pozornost zaměřena na vysvětlení jednotlivých obecných právních pojmů souvisejících s problematikou evidování budov, přičemž podrobněji je v práci pojednáno o nově zavedeném institutu práva stavby. Práce se dále pokouší objasnit specifika staveb významných z pohledu katastru nemovitostí. Závěrem se bakalářská práce zabývá zápisy vlastnických práv, vyznačováním nově zavedených institutů na listy vlastnictví a je ukončena zhodnocením platné právní úpravy.

Abstract:

This bachelor´s thesis deals with the current issues related to building registration in the land register especially in connection with the efficacy of the Civil Code, the new Cadastral Act and its implementing decree. Legislation concerning building registration is briefly summarised at the beginning of the thesis. Furthermore, attention is paid to explanation of the individual general legal concepts relating to the issue of building registration. The newly introduced institute of the building right is dealt with in more details in the work. The thesis also tries to clarify the specifics of buildings relevant from the point of view of the real estate cadastre. In conclusion, the thesis deals with registration of ownership rights, marking the newly established institutes into the property certificates. The work is concluded by the evaluation of the valid legislation.
