Application of the Better Regulation concept in selected countries

Abstract:

Celosvětová snaha o zlepšení regulačních procesů a eliminaci nadměrných a nepřiměřených dopadů regulace vedla k vzniku konceptu Better Regulation, který je na úrovni EU stále více prosazován a doporučován. Jak vyplývá z analytických zpráv OECD a EU i odborné literatury, proces hodnocení dopadů regulace je aplikován velmi různorodě. Cílem práce bylo proto zodpovědět výzkumnou otázku: Jak se v současné době liší implementace konceptu Better Regulation v rámci procesu přijímání nové legislativy v České republice, Velké Británii, Austrálii a na Slovensku? Na základě detailní analýzy požadavků a doporučení Better Regulation byly sestaveny dílčí kritéria a otázky, které byly vyhodnoceny v rámci analýzy dokumentů pomocí kódování v jednotlivých zemích (doporučení na implementaci hodnocení, předpisů, návodů, důvodových zpráv a dalších identifikovaných dokumentů definujících požadavky a procesy spojené s hodnocením dopadů regulace). Z komparativní analýzy vyplývá, že koncept je z vybraných zemí nejvíce rozvinut v Austrálii a Velké Británii, kde je taktéž největší mírou aplikován. Situace v České republice a na Slovensku je obdobná, chybí zde především vyhodnocení ex post. Naopak u ex ante hodnocení dosáhly všechny sledované země nadprůměrné hodnocení vůči ostatním zemím OECD. V rámci zapojení stakeholderů do vývoje regulací měly všechny země až na Českou republiku nadprůměrné výsledky. Rozdíl v přístupu byl patrný také z porovnání zpráv k hodnocení dopadů vztahujících se k regulaci jednorázového plastu. Austrálie a Velká Británie naplnily téměř veškerá kritéria s pozitivním výsledkem. Dobré úrovně dosáhla i Česká republika, naopak v případě Slovenska nebyla řada kritérií dostatečně naplněna.

Abstract:

The worldwide effort for the improvement of regulatory processes and the elimination of excessive regulation impacts led to the creation of the Better Regulation concept, which is made more prominent and is being recommended more often at the EU level. The process of evaluating the impacts of regulations is implemented very differently in various countries, as the reports of OECD and EU imply, supported by academic literature. The aim of this thesis was to answer the research question: How does the implementation of the Better Regulation concept to the process of adoption of new legislation differ between Czech republic, Great Britain, Australia and Slovakia? Based on a detailed analysis of the requirements and recommendations of Better Regulation, criteria and questions were compiled and evaluated based on the analysis of documents and coding. The recommendations for implementing evaluation, regulation, instructions, explanatory memorandums and other identified documents defining the requirements and processes connected to regulation impact assesment were evaluated. The comparative analysis shows that out of the compared countries, the Better regulation concept is the most developed in Australia and Great Britain, where it's also applied best. The situation in the Czech republic and Slovakia is similar, although there is some absence of ex post evaluation. Regarding ex ante evaluation, all of the countries except the Czech republic were rated above average, compared to other countries of OECD. Regarding the involvement of stakeholders, all countries except for the Czech republic had placed above average. The difference in approach was evident from comparing the impact assesment reports regarding the regulation of single use plastic. Australia and Great Britain fulfilled almost all of the criteria and had positive results. The Czech republic was on a good level, but in the case of Slovakia, several criteria were not fulfilled.
