The relation between offence and administrative infraction (substantive and procedural aspects)

Abstract:

Námět diplomové práce je zaměřen na problematiku procesního řešení hmotně právního vyhodnocení protiprávního skutku na území České republiky podle příslušných právních předpisů, vycházejících ze stavu právní úpravy ke dni 1. ledna 2015. Práce ve svém úvodu vymezuje základní východiska příslušné právní úpravy, které budou posléze rozděleny na dvě hlavní části, a to v prvním případě východiska trestního práva a v druhém případě východiska přestupkového práva. V následující třetí kapitole bude specifikován jejich vzájemný vztah, včetně určení vzájemného vztahu vybraných bagatelních trestních činů a přestupků. Ve čtvrté kapitole práce uvádí hlavní zásady trestního a přestupkového řízení. Hlavní částí práce bude tedy analýza vzájemného poměru hmotně právních ustanovení mezi trestným činem a přestupkem s využitím metody syntézy a komparace získaných poznatků. Závěr, který je uveden v poslední páté kapitole uvádí celkový souhrn vypracovaného tématu a úvahy de lege ferenda s vyhodnocením aktuálnosti, potřeby změn a procesní aplikaci právní úpravy v tomto směru.

Abstract:

The topic of the thesis is focused on the issue of procedural solution of substantive legal assessment of the illegal act in the area of the Czech Republic under the relevant legislation, based on the state law of 1 January 2015. The thesis in its introduction defines basic assumptions of the relevant legislation that will be later distributed into two main parts, firstly the basis of criminal law and secondly the basis of offence law. The third chapter specifies their relationship and specifies the relationship of the selected trivial crimes and misdemeanors. In the fourth chapter, the main principles of criminal and offence proceedings are presented. The main part of the work will be to analyze the mutual relationship between the substantive law provisions of crimes and offenses using the methods of synthesis and comparison of the findings. Conclusion, which is listed in the final chapter, presents an overall summary of the topic and the idea of de lege ferenda with an evaluation of timeliness, need for changes and procedural application of the legislation in this direction.
