Using duty weapon as the "ultima ratio" of the intervening municipal police officer

Abstract:

Tato práce je primárně zaměřena na výklad a analýzu právní úpravy oprávněného použití zbraně strážníkem, zpočátku se však zabývá oprávněným použitím zbraně jakožto jedním z institutů okolností vylučujících protiprávnost. Dále se práce zabývá problematikou neozbrojenosti obecní policie a komparací podmínek institutu oprávněného použití zbraně strážníka s příslušníkem Policie České republiky. Na základě zjištěných nedostatků v souvislosti s ustanovením oprávněného použití zbraně strážníkem práce následně formuluje návrhy de lege ferenda.

Abstract:

This bachelor theses is primarily focused on interpretation and analysis of the legislation on authorized use of weapon by municipal police officer. Initial aim of the theses is to analyze authorized use of weapon as one of the circumstances excluding illegality. Furthermore, the theses analyze the issue of unarmed municipal police and compares conditions of authorized use of weapon applied to municipal police officer with those applied to state police officer. Based on identified inadequacy of the legal provision regarding the authorized use of weapon by municipal police officer, the theses then formulates de lege ferenda proposals.
