Development of children protectivity discourse in Czech law

Abstract:

Dětství a ochrana dítěte jsou výdobytky moderní společnosti. Protektivitu dítěte lze charakterizovat jako společenskou potřebu zvýšené pozornosti vůči dětem a věcem, jež je obklopují. Jedním z nositelů protektivity mohou být právní dokumenty, které odrážejí normativní vnímání života dítěte. Tato práce přináší analýzu diskurzu dětství v českém právu od 19. století po současnost a snaží se zodpovědět otázku, do jaké míry právo reflektuje společenské vnímání dítěte a jeho potřeb a nakolik se diskurzy právního a společenského pojetí dítěte setkávají. Práce si také všímá proměňující se rodičovské role, která získává se zakotvením dítěte v zákonech celospolečenský rozměr. Hlavním cílem je zrekonstruovat diskurz protektivity dětí v obsahu legislativy rodinného práva, legislativy o sociálně-právní ochraně dětí a v mezinárodních úmluvách na ochranu dítěte. Analýza představuje snahu o postihnutí změn, které se postupně dostávaly do norem, podle nichž se reguluje a podmiňuje ochrana dětí. Výsledná zjištění práce pak rámují společenský obraz obecného vztahu mezi dospělými a nedospělými.

Abstract:

Childhood and child protection are concepts inherent to modern society. The protectivity of a child can be characterized as a social need for heightened attention towards children and the environment which surrounds them. One of the bearers of protectivity are legal documents which reflect the normative perception of the child's life. This thesis offers an analysis of the discourse of childhood in the Czech law since the 19th century up to the present day and attempts to answer the question as to how far does the law reflect the social perception of the child and its needs and to what degree do the discourses of the legal and the social conception of the child overlap. The thesis also reflects on the change in parental roles which due to the implementation of the concept of the child in the legal system assumes a societal dimension. The main goal is the reconstruction of the child protectivity discourse in the contents of family-related legislature, the social-legal child protection legislature and international child protection treaties. The analysis represents an attempt to grasp and describe the changes that eventually found their way into legal norms which regulate and condition child protection. The resulting findings frame the social image of the general relations of adults and non-adults.
