Tax aspects of the cost eligibility for long-term financing

Abstract:

Tato bakalářská práce má za cíl objasnit, jakým pravidlům budou podléhat nově stanovená omezení daňově uznatelných úrokových nákladů. Tato změna je vyvolána implementací směrnice Evropské Unie, kterou se stanoví pravidla proti vyhýbání se daňovým povinnostem. Směrnice byla vydána v návaznosti na projekt Organizace pro hospodářskou spolupráci a rozvoj, který formou doporučení nabádal k řešení otázek eroze daňových základů a přesunu zisků. Teoretická část této práce se věnuje stávajícím výhodám dluhového financování pro podniky. Praktická část rozebírá implementaci pravidla limitujícího daňově uznatelné úroky a zpřísnění oproti stávajícímu pravidlu. Rozdílný dopad je demonstrován na výpočtu stávajícího pravidla nízké kapitalizace a nově zaváděného pravidla, které limituje úrokové náklady maximálně do 30% EBITDA, na vybrané společnosti.

Abstract:

The goal of this bachelor thesis is to clarify the rules which will be applied on the newly established restrictions of tax-deductible interest expenses. This change is caused by implementation of the European Union directive determining rules against tax evasion. The regulation was issued in connection to the project of the Organization for Economic Co-operation and Development (OECD) urging to solve questions of base erosion and profit shifting. The theoretical part of the thesis is focused on the existing advantages of debt financing for companies. The practical part analyzes implementation of the rule restricting tax-deducible interest and tightening when compared to the existing rule. Different effect is illustrated by the calculation of the current thin capitalisation rule and the newly implemented rule that restricts interest costs to a maximum of 30% EBITDA on a selected company.
