Abstract:

Předmětem zpracování mé diplomové práce, s názvem „Tresty a trestání“ jsou některé úvahy vycházející z analytických poznatků aplikace jednotlivých zásad ukládání sankcí v podobě trestů. Následuje výčet druhů trestů a opatření, které obsahuje platná právní úprava v trestním zákoníku, v zákoně TOPO a v zákoně o soudnictví ve věcech mládeže. Její členění do pěti kapitol obsahuje: kapitola první „Výklad základních pojmů“, kapitola druhá „Historie trestání“, kapitola třetí „Teorie trestání“, kapitola čtvrtá „Sankce podle trestního práva“ a kapitola pátá „Druhy trestů“. Jádrem práce je kapitola čtvrtá a pátá, které obsahují též zkoumání dané problematiky z pohledu právní úpravy, její efektivity, včetně dílčích analytických a částečně syntetických závěrů. V závěru celé práce jsou komentovány shrnující poznatky z jednotlivých kapitol a doporučení. Cílem práce bylo tedy zanalyzovat problematiku uvedenou především v kapitole čtyři a pět, poukázat na nedostatky současné platné právní úpravy. Uvést poznatky, které vycházejí z analyzovaného stavu výkonu trestů. V tomto závěru jsou obsaženy úvahy právních souvislostí a návrhů řešení určitých zjištěných nedostatků. V celkovém závěru je provedeno shrnutí předchozího, včetně některých návrhů de lege ferenda.

Abstract:

The subject of this thesis, entitled "Punishments and punishing”, are considerations based on analytical findings of application of individual principles of imposing sanctions in the form of punishments, a list of the types of punishments and measures contained in the applicable legislation in the Criminal Code, the TOPO Act and the Act on Juvenile Justice. It is divided into five chapters: Chapter One “Interpretation of Basic Terms”, Chapter Two “Punishment History”, Chapter Three “Punishment Theory”, Chapter Four “Sanctions under Criminal Law” and Chapter Five “Kinds of Punishments”. The core of the work are the fourth and fifth chapter, which also include an examination of the issue in terms of legislation, its effectiveness, including partially analytical and partially synthetic conclusions. Following is a summarization of knowledge from individual chapters and recommendations. The aim of the thesis was to analyze the issues of Sanctions under Criminal Law and Kinds of Punishments, point out the shortcomings of the current legislation and state the findings that are based on the analyzed state of the execution of sentences. In the conclusions can be found considerations of the legal context and proposals for addressing certain identified shortcomings as well as the overall summary of the previous chapters, including some proposals de lege ferenda.
