The Clasification and Categorisation of Crimes in the New Criminal Code

Abstract:

Tato práce rozebírá problematiku Klasifikace a kategorizace trestných činů v novém trestním zákoníku č. 40/2009 Sb.(TrZ) Zaměřuje se na obecné přiblížení klasifikace a kategorizace, její zákonitosti, vymezení a vysvětlení jednotlivých pojmů, porovnání jejich stěžejních znaků, účel a druhy, jak z hlediska teoretického, tak z hlediska historie trestního práva na území ČR od roku 1950. Pro porovnání se zahraniční úpravou je zde nastíněn přístup slovenského trestního zákona. V závěru práce je shrnutí zjištěných poznatků a doporučení dalších možných řešení.

Abstract:

This thesis deals with the classification and categorization of crimes in the New Criminal Code No. 40/2009 Sb. There is also analyzed general approach of classification and categorization, its laws, the definition and explanation of terms, comparing its main characteristics, purpose and types, from both theoretical and historical aspects of criminal law on the territory of the ČR from 1950. For comparison, with the foreign legislation, there is outlined the Slovak Criminal Code. The conclusion is a summary of the facts and the recommendations of other possible solutions.
