Abstract:

Na území České republiky se nalézá množství starých důlních děl. Jejich právní úprava představuje specifický institut českého horního práva. Základ současné právní úpravy pochází z roku 1988 a od té doby nezaznamenal výraznějších, systémových změn. Skutečnost, že tato oblast horního práva dostatečně nereflektovala ekonomicko-společenské změny období po roce 1989, které oblast hornictví významně zasáhly, vytvořila prostor pro vznik ne příliš průhledného systému postupů a činností orgánů veřejné správy. Tento systém je odrazem praxe, která vyžaduje určitá řešení, se kterými však legislativa v některých případech nepočítá. Absence relevantní judikatury, která by alespoň částečně suplovala chybějící právní úpravu, ukazuje, že se jedná o oblast na okraji společenského zájmu. Výsledkem současného stavu je existence systému činností a postupů, který sice v rámci možností funguje, ale zároveň neřeší podstatné otázky jako je např. vlastnictví starých důlních děl nebo proces převodu práv ke starým důlním dílům. Koneckonců i samotné udělování statusu starého důlního díla vzbuzuje určité pochybnosti. Jak se říká, kde není žalobce, není ani soudce. A vzhledem k tomu, že společenská, ani politická poptávka po úpravě stávajícího systému není, bude existence stávajícího stavu nejspíše i realitou dalších let.

Abstract:

There are many attles (old abandoned mines) in the territory of the Czech Republic and their legal framework is a specific part of Czech mining legislation. The foundation of lawframe was laid in 1988 and since then it has not been changed much, even though mining as a part of the Czech economy has been significantly influenced by the economic and social changes in 1989. The fact, that the legislation has not incorporated any amendments, created not a very transparent environment of the state authorities' processes and procedures. This system is only a result of practice calling for solutions, which are not covered by legislation at all. The absence of an applicable legislation could be substituted by some relevant case law. Unfortunately there is neither, which only shows, that this topic is at the edge of general interest. As a result of the current state, the system of procedures works to a limited extent. Nevertheless at the same time it does not give any guidance for some very core topics, such as ownership of attles or ownership rights transferring procedure. After all, the attle status granting process itself raises doubts. The expression "Where there is no plaintiff, there is no judge" fits in this situation and considering that there is no social or political demand for correction, the status quo will most probably remain intact in upcoming years.
