Abstract:

Dizertační práce se věnuje problematice kodifikace v daňovém právu. Na základě zahraniční a domácí právní teorie studovala autorka kodifikaci ze dvou hledisek: jako právní jev a jako činnost zákonodárce při racionalizaci současné právní legislativy. V průběhu výzkumu byly ana-lyzovány monografické práce zahraničních a domácích vědců-právníků. Na základě doktrinálních pohledů a historického vývoje ko-difikačních jevů, jsou definovány základní charakteristiky pojmů kodi-fikace, dekodifikace a rekodifikace. Na příkladu finanční a právní teorie České republiky, jako členského státu Evropské unie, a současně Ruské Federace, jako postsovětského státu stojících mimo EU, je zkoumána otázka možnosti a potřeby kodifikace daňového práva, je formulována představa autorky o Kodexu, jako jednom z výsledků kodifikační činnosti. První část práce je věnována teoretickým základům kodifikačních jevů, analýze jejich dopadů na systém práva a právní řád. Cílem druhé části práce je porovnat výsledky kodifikačních procesů v daňovém právu a daňové legislativě v členských státech Evropské unie a současně i v postsovětských státech stojících mimo EU, zejména v Ruské Federaci.

Abstract:

The thesis deals with the problem of codification in tax law. Based on foreign and domestic legal theory, the thesis considers codification from two points of view: as a legal phenomenon, and as the activity of the legislator in streamlining current legislation. In the course of the study, monographic works of foreign and domestic jurists have been analysed. Based on doctrinal views and the historical development of codification phenomena, fundamental characteristics of the concepts of codification, decodification, and recodification have been determined. On the example of the financial and legal theory of the Czech Republic, as the EU member-state, and the Russian Federation, as the post-Soviet country outside EU, questions about the possibility and need for codifi-cation of tax law have been examined, the author's idea of the Code as one of the results of the codification activities has been formed. The first part of the paper focuses on the theoretical foundations of the codification phenomena, the analysis of their impact on law, and the system of legislation. The second part of the thesis aims at comparing the results of the codification phenomena in tax law and tax legislation in the EU member-states as well as in the post-Soviet countries outside EU, namely in the Russian Federation.
