Penalty finding commission at Broumov 1945 - 1947

Abstract:

Bakalářská práce se zabývá problematikou poválečného retribučního soudnictví v Československu, konkrétně analyzuje průběh tzv. malé retribuce. Na základě studia dobových pramenů a komparace s poznatky z odborné literatury věnující se této problematice se snaží charakterizovat činnost Trestní nalézací komise v Broumově v prvním retribučním období v letech 1945 ? 1947. První část práce se zabývá teorií a okolnostmi vzniku retribučních dekretů, především vznikem tzv. malého retribučního dekretu a činností trestních nalézacích komisí v českých zemích. Část druhá již podrobně analyzuje činnost Trestní nalézací komise v Broumově společně s uvedenými vybranými řešenými kauzami. Na konci práce jsou uvedeny přílohy, které obsahují kompletní seznam osob, jež se objevily před broumovskou komisí v prvním retribučním období a rovněž celé znění dekretů č. 16, 17, 138 a amnestii prezidenta republiky Klementa Gottwalda z 18. června 1948. Stěžejním pramenem mé práce byl fond ONV Broumov, který je uložen ve Státním okresním archivu v Náchodě.

Abstract:

This Bachelor thesis deals with issues of after war vindicative judiciary in the Czechoslovakia, it is concerned particularly with analysing so called Small Retribution. The thesis endeavours to characterise work of Penalty finding comisson in Broumov in the first retribution period between years 1945 and 1947 by studying and comparing contemporary sources with the literature which presents information connected to this issue. The first part focuses on the theories and circumstances of the emergence of the vindicative Decrees, particularly on the emergence of the Small viddicative decree and on the work of Penalty finding comission in the Czech Lands. Second part analyses in detail the work of Penalty finding comission in Broumov together with presented selected solved cases. In the end of the paper, there are attachments which contain complete lists of people who stood in front of the committee in Broumov in the first retribution period. There are also full wordings of decrees number 16, 17, 138 and of amnesty of the President Klement Gottwald from June 18, 1948. The most important source of this paper is fund ONV Broumov which can be found in State Regional Archive in Náchod.
