Legal Acts of Arbitrary Legislator

Abstract:

Ústavní soud jakožto ochránce ústavnosti ruší ty zákony, které odporují ústavnímu pořádku, přičemž akt přijetí některých z těchto neústavních zákonů zároveň označí za svévoli. Soud tak používá pojem svévole pro určení některých chybných jednání zákonodárce, nicméně tento pojem nijak uceleně nedefinuje. Pokládám si proto otázku, jak zpřesnit porozumění konceptu svévole zákonodárce. Není mým cílem nabídnout komplexní definici, nýbrž učinit první kroky k jejímu lepšímu pochopení. Vycházím při tom především z primárních zdrojů, tedy z nálezů Ústavního soudu. Na jejich základě vytvářím typologii svévolí a popisuji charakteristiky jednotlivých typů. Z nálezů Ústavního soudu plyne, že se svévole odehrála při přijímání právního aktu. Takový právní akt může být následně zrušen Ústavním soudem, přičemž praxí Ústavního soudu je rušit zákony, včetně těch svévolně přijatých, s účinky ex nunc. A to ke dni zrušujícího nálezu popřípadě ke dni pozdějšímu. Mezi svévolným přijetím právního aktu a jeho zrušením pro neústavnost tak může uplynout i několik let. Problém, o jehož vyřešení usiluji, je zjistit, co se s právním aktem během této doby událo a kdy se stal neústavním. Za použití kombinace deduktivního a induktivního přístupu k nálezům a ke způsobu rozhodování Ústavního soudu, odhaluji systém vztahů mezi svévolí zákonodárce a neústavností právního aktu. Představuji a obhajuji tezi, podle které neústavnost právního aktu nevzniká ani automaticky ani nutně a ani okamžitě po té, co byl právní akt svévolně přijat.

Abstract:

Constitutional court abolishes every law which is in conflict with the constitutional order. In some cases, after the court abolishes the law, he simultaneously entitles the adoption of this law as arbitrariness of lawmaking body. Constitutional court uses the concept of arbitrariness to designate certain wrongful acts of the lawmaking body. Nevertheless, the court does not provide any complex definition of the concept of arbitrariness. In a few cases the court gives us at least generalizations and descriptions of the arbitrariness of the lawmaking body. However, those generalizations are able to cover some cases of arbitrariness, but definitely not all of them. In this thesis I am trying to answer how to refine the insight to the concept of arbitrariness of the lawmaking body. I do not seek to introduce a complex definition of this concept. I am rather trying to make first steps for its better understanding. My research is based on primary sources, in this case the judgements of Constitutional court. Based on their analysis I will create a typology of the arbitrariness of lawmaking body and describe characteristics of each type. The arbitrariness of the lawmaking body is an act that happened during a legislative process. Later, the law can be abolished by the Constitutional court. The abolition of the law takes effect ex nunc, not ex tunc. This means that the law exists during the time between its adoption and its abolition. This brings me to another question: What happened to this law during the time between its adoption and abolition and when the law became unconstitutional? In order to answer the question about relationship between the arbitrariness and the unconstitutional character of the law, I am using deductive and inductive approach to judgements of the Constitutional court. Thereafter I am introducing a theory that the law, which was adopted arbitrarily, does not become unconstitutional neither right after of its adoption nor automatically. And furthermore, the law even does not have to become unconstitutional.
