Abstract:

Tato diplomová práce se věnuje problematice oddlužení fyzických osob v České republice, tak jak je definováno v Insolvenčním zákoně. Vzhledem k faktu, že Insolvenční zákon prošel v roce 2019 novelizací, která se oddlužení fyzických osob významně dotkla, je hlavním cílem práce komparace předchozí a současné právní úpravy tohoto institutu. Práce se rovněž zabývá legislativním procesem, který vedl k přijetí této novelizace, s důrazem na sledování změn zákona dotýkajících se oddlužení fyzických osob. V další části práce je současná právní úprava oddlužení fyzických osob komparována s právní úpravou ve Spojeném království.

Abstract:

This diploma thesis is devoted to the issue of the personal bankruptcy in the Czech Republic as defined in the Insolvency Act. Given the fact that the Insolvency Act underwent an amendment in the year of 2019, which significantly affected the personal bankruptcy process. The main aim of the thesis is to compare the previous and current legislation of this institute. The thesis also deals with the legislative process that led to the adoption of this amendment, with a focus on monitoring changes in the personal bankruptcy law. In the next part of the thesis the current legal regulation of personal bankruptcy is compared with the legal regulation of personal bankruptcy in the United Kingdom.
