Appointment of the Heir in the Czech law in 20th Century

Abstract:

Práce se věnuje právní úpravě dědické instituce a s ní související vybrané problematice v českých zemích ve 20. století. Cílem práce je představení a vzájemná komparace úprav při zohlednění společenské situace, ve které se vyvíjely. Výchozí je právní úprava římského práva, a to z důvodu jejího patrného vlivu na další zákoníky. Stěžejními předpisy jsou ABGB a občanské zákoníky z roku 1950 a 1964. Práce se zabývá i meziválečnými návrhy občanského zákoníku z let 1931 a 1937. Pozornost je krátce věnována i období protektorátu Čechy a Morava a závěrem je stručně zmíněn občanský zákoník z roku 2012.

Abstract:

The thesis deals with the legal regulation of the appointment of the heir and related issues in the Czech lands in the 20th century. The aim of the work is to introduce and compare the legal regulations, taking into account the social situation. The starting point is Roman law, due to its influence on other codes. The main codes are the ABGB and the Civil Codes of 1950 and 1964. The thesis also deals with the interwar drafts of the Civil Code of 1931 and 1937. Attention is briefly paid to the period of the Protectorate of Bohemia and the Moravia and at the end also to the Civil Code of 2012.
