Expropriation for the purpose of accelerating constructure of transport infrastructure

Abstract:

Předmětem diplomové práce je problematika vyvlastnění týkající se urychlení výstavby dopravní infrastruktury. Právní úprava vyvlastnění není ucelená, a tak se tato diplomová práce zabývá obecnou úpravou vyvlastnění podle zákona č. 184/2006 Sb., zákona o odnětí nebo omezení vlastnického práva k pozemku nebo ke stavbě (zákon o vyvlastnění) a také úpravou speciální, kterou je zákon č. 416/2009 Sb., zákon o urychlení výstavby dopravní, vodní a energetické infrastruktury a infrastruktury komunikací (liniový zákon). Vlastní text práce se skládá z úvodu, pěti kapitol a závěru. Text vychází primárně z platné právní úpravy, soudní judikatury, odborné literatury a dalších zdrojů. V první kapitole je čtenář seznámen s obsahem vlastnického práva a jeho možným omezením, pojmem vyvlastnění, právní úpravou a podmínkami vyvlastnění. Následující kapitola se věnuje liniovému zákonu, jeho historickým vývojem, předmětem a vztahem k dalším právním předpisům. Stěžejní část práce se zaměřuje na vyvlastňovací řízení. V této části je popsán postup před vyvlastněním, kde je nastíněna vyjednávací fáze podle obecné a zvláštní úpravy, jednání o kupní ceně a právo vstupu na pozemek. Poté je pojednáno o zahájení vyvlastňovacího řízení a jsou rozebrány jednotlivé subjekty řízení. Stručně je též popsán postup v řízení, včetně ústního jednání a možné vyřízení věci přerušením nebo zastavením řízení. Následně je rozebráno ukončení ve věci samé rozhodnutím a zvláštní typ mezitímního rozhodnutí. Tato část se zabývá ještě odvoláním a případným zrušením odvolání. Pátá kapitola popisuje soudní ochranu při vyvlastnění, jež je ve vyvlastnění duální. Dochází k přezkumu správními soudy a také civilními soudy. V poslední kapitole je analyzován případ stavby dálnice D3 a autor se zde zamýšlí nad úvahami de lege ferenda.

Abstract:

The subject of the thesis is the issue of expropriation related to accelerating the construction of transport infrastructure. The legal regulation of expropriation is not comprehensive, and so this thesis deals with the general regulation of expropriation under Act No. 184/2006 Coll., the Act on the withdrawal or limitation of the right of ownership to land or to a building (the Act on Expropriation) and also with the special regulation, which is Act No. 416/2009 Coll., the Act on accelerating the construction of transport, water, energy and communication infrastructure (the Linear Act). The actual text of the thesis consists of an introduction, five chapters and a conclusion. The text is based primarily on the applicable legislation, court case law, specialist literature and other sources. In the first chapter, the reader is introduced to the content of the property right and its possible limitations, the concept of expropriation, legal regulation and conditions of expropriation. The following chapter is devoted to the Linear Act, its historical development, subject matter and relation to other legal regulations. The main part of the thesis focuses on the expropriation procedure. This section describes the procedure prior to expropriation, outlining the negotiation phase under the general and special regulations, the negotiation of the purchase price and the right of entry. The initiation of the expropriation procedure is then discussed and the different subjects of the procedure are described. The procedure in the proceedings is also briefly described, including the oral hearing and the possible settlement of the case by staying or discontinuing the proceedings. Subsequently, the termination on the merits by decision and a specific type of interim decision are discussed. This section also deals with appeals and the possible annulment of appeals. The fifth chapter describes the judicial protection in expropriation, which is dual in expropriation. There is review by administrative courts and also by civil courts. In the last chapter, the case of the construction of the D3 motorway is analyzed and the author reflects on de lege ferenda considerations.
