Abstract:

Tématem této diplomové práce je "Prodlení a jeho následky". Zaměřuje se na historický vývoj prodlení a jeho druhy, osvětluje základní pojmy, které jsou klíčové pro dané téma. Podrobně jsou charakterizovány jednotlivé právní následky prodlení dlužníka, věřitele a následky jim společné. Cílem této práce je podat obecný pohled na problematiku prodlení a jeho následků ve světle nejen současného občanského zákoníku, nýbrž i v úpravách starších, se zaměřením na zajímavé a problematické oblasti.

Abstract:

The topic of this diploma thesis is "Default and its consequences". It focuses on the historical development of default and its consequences, division of default and basic terms that are key to the topic. The individual legal consequences of the debtor's and creditor's default and the consequences common to them are characterized in detail. The aim of this thesis is to provide a basic insight into the issue of default and its consequences in the light of not only the present Civil Code but also of the antecedent legal regulations and to point out some of the interesting and problematic areas.
