Bank Letters of Credit

Abstract:

Práce se zabývá dokumentárními akreditivy s důrazem na srovnání aktuální české právní úpravy, budoucí právní úpravy, jednotných zvyklostí a pravidel UCP 600. V první části jsou popsány charakteristické znaky a principy akreditivů spolu s jejich jednotlivými typy, průběh akreditivní operace a její strany. V druhé praktické části je analyzován přezkum dokumentů s důrazem na přezkum nedokumentárních podmínek, nárok potvrzující banky na hojení, vystavení akreditivu bankou za sebe, akreditivní podvody a ochrana příkazce.

Abstract:

The work focuses on letter of credit, with emphasis on comparing the co-temporary and prospective Czech law and Uniform Customs and Practice for Documentary Credits UCP 600. The first part describes characteristics of letters of credits and principles governing it, together with its different types, process of LC transaction and its parties. The second, practical part, analyses the examination of documents, with emphasis on examination of non–documentary conditions, the right of confirming bank for reimbursement, possibility to issue LC on the bank’s own behalf, LC frauds and protection of the applicant.
