Abstract:

Tato práce se zabývá většinou oblastmi vztahujícím se k dané problematice, které jsou dle mého názoru důležité pro získání obecného přehledu o etice advokáta. Tato oblast je na rozdíl od ostatních oblastí práva poněkud novodobějším fenoménem, než jsou právní normy samotné, a i když je systém právních norem dosti propracovanou oblastí, etika výkonu advokacie je ve srovnání teprve novinkou. V této souvislosti se práce zabývá v mezích i historickým vývojem advokacie, jelikož měl podstatný vliv na současnou podobu právní etiky. O této problematice neexistuje mnoho literatury, což je dáno skutečností, že je to novodobý fenomén, a také tím, že se jedná spíše o jakási pravidla slušného chování při výkonu profese advokáta. Vzhledem k faktu, jak dynamickým vývojem současná společnost prochází, je nutné, stejně tak jako i v jiných oborech, stanovit určitá pravidla, kromě samotných právních norem, jakými lidskými a morálními pravidly se advokacie bude řídit, tedy zjednodušeně řečeno, stanovit pravidla slušného chování. A právě tímto se celá práce obsahově zabývá. Práce pojednává i o obecné etice, advokacii, advokátovi a také o etických kodexech, ve kterých jsou právě tyto pravidla stanovena. Součástí tohoto tématu je také oblast samotných povinností a práv advokáta, jak ve vztahu ke klientovi, vůči Komoře, tak i vůči advokátnímu stavu, tedy etika advokáta v obecné rovině. V neposlední řadě se práce věnuje i faktorům, které mohou méně či více ovlivnit chování advokáta při výkonu jeho povolání. Věnuje se takovým skutečnostem jako je kolegialita, střet zájmů či reklama advokáta. Byť žijeme ve společnosti, která je právně vyspělá, etika a společenská morálka, pokud nejsou stanoveny jasnými pravidly, by mohly vézt k následkům, které by mohly poškodit jednotlivé strany. Proto i porušování advokátní etiky je důležitým bodem, který je v práci k nalezení. Konec práce se dostává k závěru, že i když jsou tyto pravidla již pevně ukotvena a všichni advokáti jsou s nimi plně obeznámeni, a to i s kárnými postupy v případě nedodržení těchto pravidel, záleží v neposlední řade pouze na samotném advokátovi, na jeho morálních, osobních a lidských vlastnostech, které si každý člověk nese s sebou, aby mohl reprezentovat samotné právo, ale i zájmy klienta, který se práva domáhá.

Abstract:

My work deals with most areas which cover the given topic, and also which are necessary, according to my opinion, to broadly understand advocates? ethical approach to his profession. Unlike other fields of the legal system, it is a relatively contemporary phenomenon, in comparison to the legal system itself, and despite the fact, that the legal system has undergone long evolution throughout history, the ethical code of practise is relatively modern approach. Bearing this in mind, I had to look at the historical evolution of advocacy, which had a significant influence on the current form of legal ethics. My statement supports the fact, that there is not much literature covering this topic, which suggests the modernity and short term span of evolution, and also simply because it deals to a certain extent with the rules of proper behaviour and morale within the advocates practise. With regard to the dynamic development of the current system, it is necessary like in other professions, to establish certain rules, apart from the legal formatives, what moral and personal qualities the advocate should possess, in short, establish certain morale. And this is what my work mainly deals with. It deals mostly with general ethics, advocacy, and the advocate and also about ethical codex, in which are these rules set. In addition I am also covering the area of the legal framework of advocates rights and duties, with regard to the client, to the Bar Association, the ethics of an advocate in general. Last but not least i am covering the factors, which may more or less influence the behaviour of an advocate. I am covering such areas as collegiality, the conflict of interests and advertising of an advocate. Although we live in a society, which is legally advanced, ethics and morale, if they are not defined by rules and followed, may lead to consequences, which could be to the detriment of the respective parties. Therefore the breach of advocate?s ethics is an important point to cover. At the end of my work I have reached a conclusion, that if certain rules by which the advocate operates are not established, and also acquainted with the consequences of such breach, it is the advocate?s moral and personal values, which he carries with him, to represent law itself, the interests of a client.
