The Pledge of the property

Abstract:

V mé bakalářské práci se budu zabývat zástavním právem k nemovitým věcem, a to od jeho historického vývoje v českých zemích až po současnou právní úpravu. Toto téma je aktuální v každé době a bylo aktuální i za každé právní úpravy. Cílem této práce je rozbor dopadů právní úpravy zástavního práva k nemovitým věcem po rekodifikaci soukromého práva v České republice v r. 2014. V práci bude rozebrána všeobecná funkce zástavního práva k nemovitým věcem od jeho vzniku po jeho zánik. K dosažení tohoto cíle byla použita dosavadní právní úprava, dostupná judikatura a současná právní úprava, především nový občanský zákoník. Závěrem této práce byla rozebrána právní úprava týkající se zásady materiální publicity.

Abstract:

In my bachelor thesis I will deal with mortgage right to real estate, from its historical development in the Czech lands to the current legal regulation. This topic is up-to-date at all times and was up to date for every legal regulation. The aim of this work is to analyze the impact of the legal regulation of pledge on immovable property after the recodification of private law in the Czech Republic in 2014. The thesis will analyze the general function of lien on immovable property from its creation to its termination. To achieve this goal, the existing legislation, available case law and current legislation, in particular the new Civil Code, have been used. The conclusion of this thesis was the legal regulation concerning the principle of material publicity.
