Psychological Testing in Labour Law Relationships

Abstract:

Tato práce se zabývá používáním psychologických testů v pracovněprávních vztazích. Práce si klade za cíl zjistit, zda v České republice existuje účinná právní úprava této oblasti a popsat případná práva a povinnosti, které z ní vyplývají. Práce nahlíží psychologické testy jako nástroj k získávání informací a věnuje se tedy úpravě, která vymezuje okruh informací, které smí zaměstnavatel o zaměstnanci, či potencionálním zaměstnanci zjišťovat. Dále se práce věnuje psychologickým testům v jednotlivých fázích pracovněprávního vztahu a zabývá se otázkou, jakou roli v nich může psychologické testování sehrávat. V závěru se práce zaměřuje na některé významné otázky týkající se používání psychologických testů v pracovněprávních vztazích jako např., zda má testovaná osoba právo nahlížet do výsledků testů či jaké je postavení personální agentury, která provádí testování za zaměstnavatele.

Abstract:

This thesis deals with the application of psychological assessments in work relations. It aims to find out whether the Czech Republic have efficient legislation in this field and describe the optional rights and duties to employees. The thesis sees psychological assessments as tools for obtaining sensitive information and therefore it deals with legislation which delimits the range of information an employer can determine about an employee or candidate. Furthermore, the thesis follows up psychological assessments in particular stages of work relations and addresses what the role of psychological assessments is in the work place. The thesis concludes by focusing on some significant issues of using psychological assessments in work relations. For instance, whether the examined person has the right to access the results and what the responsibilities are of the employment agency running the assessments instead of the employer.
