Housing Cooperative vs. Association of Units Owners

Abstract:

Hlavním tématem této bakalářské práce je srovnání dvou u nás nejčastějších forem vlastnictví bytů – kolektivního družstevního vlastnictví a individuálního vlastnictví podle zákona o vlastnictví bytů. Teoreticko-metodologická část práce je věnována obecné analýze trhu nemovitostí v České republice, zejména segmentu bytů a dále historickému a legislativnímu vývoji bytového družstevnictví a individuálního vlastnictví bytů v bytových domech. Zmíněna je též historie právního oddělení vlastnictví stavby a pozemku a změna, kterou v tomto principu přinesl zákon o vlastnictví bytů. Teoretickým východiskem práce je pak rozbor současné legislativy, která upravuje obecné právní vztahy spoluvlastnictví, dále vlastnictví k bytům a nebytovým prostorům a současnou právní úpravu družstev a jejich transformace. V aplikační části jsou pak identifikovány rozdíly a posouzeny výhody resp. nevýhody obou zkoumaných forem vlastnictví k bytům, a to jak s ohledem na výkon vlastnických práv, tak s ohledem na správu domů a hospodaření družstev a společenství vlastníků jednotek, včetně dopadu těchto rozdílů na vedení účetnictví. V závěru práce jsou zmíněny i konkrétní problémy, se kterými se v současnosti potýkají vlastníci bytů a členové bytových družstev, přičemž jsou dány podněty k nápravě tohoto stavu.

Abstract:

The key topic of this thesis is the two most frequent types of ownership of flats in the Czech Republic - cooperative ownership and private ownership in accordance with Act on Ownership of Flats. The theoretic-methodological part of the thesis deals with an analysis of the real-property market in the Czech Republic, especially with the field of dwellings as well as historical and legislative development of housing cooperatives and individual ownership of the flats in residential buildings. Also, the history of the legal separation of the constructions ownership and parcels ownership and the changes which result from the Flat Ownership Act are included. The theoretically base of the thesis is the analysis of the current legislation bound on co-ownership as well as the ownership of the residential and non-residential premises and the current legal regulations related to housing cooperative and their transformation. In the practical part are then identified the differences and considered the advantages/disadvantages of both the analysed types of ownership of flats, both with regards to the owner’s rights application, and also the houses administration and economy, including the influence of those differences on their accounting. Finally, I also mentioned some difficulties that owners are being made to deal with, and suggested my proposals for improving this situation.
