Right of the Necessary Way

Abstract:

Tato diplomová práce se zaměřuje na celkový rozbor institutu tzv. nezbytné cesty. V práci je stručně popsána předchozí právní úprava, která na území České republiky platila před v současnosti platným a účinným zák. č. 89/2012 Sb., občanským zákoníkem. Zabývá se deskripcí podmínek stanovených zákonem a dovozených judikaturou, jež musí být splněny pro zřízení nezbytné cesty a také formami jejího vzniku, obsahem a zánikem uvedeného právního vztahu, podle stavu de lege lata. Práce se snaží poskytnout návod k řešení problematických oblastí, jež s sebou nová právní úprava přináší. Zohledněny jsou jak procesně právní aspekty při formování nezbytné cesty, tak její promítnutí do katastru nemovitostí.

Abstract:

The diploma thesis is focused on a complete analysis of the institute of the so-called necessary path. The thesis briefly reviews a prior legislation within the Czech Republic, which was in force before the presently valid and effective legal act no. 89/2012 Coll., the Civil Code. It deals with the description of the conditions which have to be fulfilled for the possibility of establishing the necessary path and with creation, content and termination of the necessary path, all according to the state de lege lata. The thesis tries to provide the guidance to resolve problematic areas that the new legislation causes. In the thesis, both the procedural aspects of the formation of the necessary path and the reflection of this legal relationship into land register are taken into account.
