Undivided co-ownership of the conjoints-agreements of the conjoints according to § 143 of the civil code

Abstract:

The theme of our work is the undivided co-ownership of the conjoints and connected agreements of the conjoints according to § 143 of the Civil Code. In the first chapter we discuss the ownership and co-ownership in a general perspective. It also deals with the emergence of BSM, its purpose and scope of things, and excluded from the BSM. In the fifth chapter we emphasize the agreement of the spouses, while the related subsections we discuss the formation and modification of form, its contents and also change and termination. The conclusion of our thesis is dedicated to termination of co-ownership in general terms and characteristics of various modes of its termination. The last chapter emphasizes the logical outcome of termination of BSM, which is the settlement of BSM. In our work we aim to provide professional resources through comprehensive conclusions on the issue of BSM especially spouses agreements.

Abstract:

Témou našej bakalárskej práce je bezpodielové spoluvlastníctvo manželov a s ním späté dohody manželov podľa § 143 OZ. V prvej kapitole pojednávame o spoluvlastníctve zo všeobecného hľadiska, pričom rozoberáme podielové spoluvlastníctvo aj bezpodielové spoluvlastníctva manželov (ďalej len BSM). Taktiež sa zaoberáme vznikom BSM, jeho predmetom a rozsahom a vecami vylúčené z BSM. V piatej kapitole kladieme dôraz na dohody manželov, pričom v prislúchajúcich podkapitolách pojednávame o vzniku a forme modifikačnej dohody, jej obsahu a taktiež zmene a zániku. Záver našej bakalárskej práce je venovaný zániku BSM zo všeobecného hľadiska a charakteristike jednotlivých spôsobov zániku BSM. Posledná kapitola kladie dôraz na logické vyústenie zániku BSM, ktorým je vyporiadanie BSM. V našej práci si kladieme za cieľ prostredníctvom odborných zdrojov poskytnúť kompletné závery týkajúce sa problematiky BSM, ale predovšetkým dohôd manželov s ním spätými.
