Lie detector as a proof instrument

Abstract:

Cílem diplomové práce je analyzovat možnosti využití detektoru lži v rámci procesu dokazování. Práce pojednává o možném využití detektoru lži v praxi za využití metody fyziodetekce, jeho historii, úskalím i možnými přínosy. Součástí práce je také výčet možných kontraindikací a možností oklamání detektoru lži, které vedou ke znehodnocení dosažených výsledků. Diplomová práce poukazuje na různá pojetí právního výkladu fyziodetekce v rámci jednotlivých států, zejména tedy těch, které jsou součástí Evropské unie. Praktická část je založena zejména na případových kazuistikách, v rámci kterých byl využit detektor lži v praxi a expertním rozhovoru s polygrafologem.

Abstract:

The goal of this diploma thesis is to analyze possibilities of using a lie detector in the process of proving. The thesis deals with the possible use of a lie detector in practice using the method of physiodetection, its history, issues and possible benefits. In the thesis is also included a list of possible contraindications and the possibility of deceiving the lie detector, which lead to the results depreciation. The diploma thesis points out different concepts of legal interpretation of physiodetection in individual states, especially member states of the European Union. Practical part is based mainly on case studies, in which a lie detector was used in the practice and interview with the polygraphologist.
